038 Endoso en Garantía

What is it?​

  • It is the electronic document by which the Issuer, Biller, or Legitimate Holder delivers an Electronic Sales Invoice considered as a Bill of Exchange to the next legitimate holder (Endorsee) as a guarantee for an obligation or credit.
  • The endorser constitutes a real guarantee of pledge on the bill of exchange, in order to back a different obligation.
  • The endorsee becomes a pawn creditor and is endorsed with the clause “endoso en garantía” or similar.
  • The title is delivered without changing the right holder.

Who is responsible for generating the electronic document?​

  • The Issuer, Biller, or its Legitimate Holder (Endorser) is responsible.

Who is responsible for receiving the electronic document?​

  • The Endorsee is responsible.
